ORDER

This is the successive bail petition filed by the petitioner.

2. The petitioner herein, who was arrested and remanded to judicial custody on 07.03.2025 in Spl.S.C. No.214 of 2025 pending trial on the file of the learned Sessions Judge, Fast Track Mahila Court, Tiruppur for the offences punishable under Section 3(a) r/w 4 of POCSO Act, 2012, seeks bail.

3. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 14.11.2025 in Crl.O.P.No.31111 of 2025 for the following reasons.

"5. Considering facts and circumstances of the case, grave nature of offence, the disturbing facts recorded in the statement of the victim child, the stage of the trial and if the petitioner is enlarged on bail, there is a possibility of hampering of trial process, hence this Court is not inclined to grant bail to the petitioner."

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 07.03.2025; that the investigation completed and final report filed in Spl.S.C. No.214 of 2025 and the case is posted for framing of charges; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 5.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the victim child is aged about 8 years at the time of occurrence; that the case is pending trial in Spl.S.C. No.214 of 2025 on the file of the learned Sessions Judge, Fast Track Mahila Court, Tiruppur and posted for framing of charges.

I have considered the submissions made on both sides and perused the materials available on record.

Without any change in circumstances, once again, the learned counsel for the petitioner has argued the matter on merits on the ground that the material witnesses were not examined during investigation. However, this court is not inclined to accept the said arguments since now this case is pending for trial.
