Prayer: This writ petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents 1 to 4 to consider the petitioner's representations, dated 31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024 and thereby convert the petitioner's provident fund from CPF Scheme (Contributory Provident Fund) to General Provident Fund from CPF Scheme (Contributory Provident Fund) to General Provident Fund under Old Pension Scheme with retrospective effect from 01.05.2003 onwards and continue to do so, till the date of retirement (i.e) upto 31-05-2030 and consequently direct the 5th Respondent to allocate funds for the same.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to consider the petitioner's representations, dated 31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024, within a time frame to be fixed by this Court.

2. The petitioner has made representations, dated 31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024 before the respondents 1 to 4 seeking conversion of petitioner's provident fund from CPF Scheme (Contributory Provident Fund) to General Provident Fund under Old Pension scheme with retrospective effect from 01.05.2003 onwards and continue to do so, till the date

of retirement (i.e.,) upto 31.05.2030. Since the same has not been considered till date, the petitioner has filed this writ petition.

3. Mrs.Sharadha Vivek, learned Additional Government Pleader (Puducherry), accepts notice on behalf of the respondents.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this Court issues direction to the respondents to consider the petitioner's representations dated 31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024, as expeditiously as possible.

5. Learned Additional Government Pleader appearing for the respondents would submit that the representations of the petitioner dated 31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024 will be considered and appropriate order will be passed within a time frame to be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Accordingly, the respondents are directed to pass final orders on merits and in accordance with law on the petitioner's representations, dated

31.03.2017, 16.03.2023, 11.08.2023, 13.09.2023 and 15.03.2024, within a period of Twelve (12) weeks from the date of receipt of a copy of this order. This Court has not expressed any opinion on the merits of the petitioner's representation.

With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
