PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to call for the records in CRP.No.3 of 2011 on the file of the Additional District and Sessions Court, Fast Track Court No.1, Coimbatore with Crime No.104 of 2010 on the file of the Central Crime Branch, Coimbatore District and set aside the conditions imposed in the order dated 25.02.2011 made therein and modify the same by granting permission to the petitioner to sell the Maruthi Alto VEHICLE bearing Registration No.TN 37 AZ 0618 by public auction or private treaty.

This Criminal Original Petition is filed to call for the records in CRP.No.3 of 2011 on the file of the Additional District and Sessions Court, Fast Track Court No.1, Coimbatore with Crime No.104 of 2010 on the file of the Central Crime Branch, Coimbatore District and Set aside the conditions imposed in the order dated 25.02.2011 made therein and modify the same by granting permission to the petitioner to sell the Maruthi Alto VEHICLE bearing Registration No.TN 37 AZ 0618 by public auction or private treaty.

2.The learned Government Advocate submitted that in the above said Criminal Original Petition the second respondent, Thirumalai Kumar has been arrayed as an accused in Cr.No.104 of https://hcservices.ecourts.gov.in/hcservices/

2010 on the file of the first respondent. The Judicial Magistrate No.3, Coimbatore in C.M.P.NO.5051 of 2014 vide order dated 12.09.2014 had handed over the ALTO Car bearing Registration No.TN 37 AZ 0618 and Honda Activa bike bearing Registration No.TN 66 6462 to the second respondent/accused. The first respondent/complainant in pursuance to the orders of the learned Judicial Magistrate No.3, Coimbatore, on 05.12.2014, had handed over the ALTO Car bearing Registration No.TN 37 AZ 0618 to the second respondent/accused. Hence, nothing survives in the above said Criminal Original Petition. 3.In view of the above, the Criminal Original Petition stands closed.
