Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus calling for the records relating to the Notification of the 2nd respondent in Advt.No.4/2008-09 dated 14.8.2008 and quash the same in so far as the selection and appointment to the post of Lecturer in the Commerce Department is concerned and consequently direct the respondents to issue fresh notification by specifically including Corporate Secretaryship Department also, so as to enable the petitioner to apply for the post of Lecturer.

J U D G M E N T
(Order of the Court was made by K.K.SASIDHARAN,J.) The Writ Petition filed by the appellant for issuance of a Writ of Mandamus to the respondents to cancel the selection already made in the post of Lecturer in Corporate Secretaryship and issue a fresh Notification for recruitment was dismissed by the learned Single Judge with a direction to the respondents 1 and 3 to include Corporate Secretaryship subject also as one of the qualification for the post of Lecturer in Corporate Secretaryship. Since there was no order to cancel the selection, the appellant has come up with this intra Court appeal.
2. We have adjourned this matter on an earlier occasion for making a statement by the Government as to whether action was taken pursuant to the direction given by the learned Single Judge to include Corporate Secretaryship subject as one of the qualification for appointment to the post of Lecturer in Corporate Secretaryship.
3. When the appeal is taken up for hearing today, the learned Special Government Pleader produced a copy of the
Government Order in G.O.Ms.No.65, Higher Education (F2) Department, dated 12.04.2018 indicating that there are five posts earmarked out of the total post of 156 for those who have qualified in the subject "Corporate Secretaryship."
4. In view of the action taken by the Government as indicated above, nothing survives for further adjudication.
5. The intra Court Appeal is disposed of with the above observation. There shall be no order as to costs. Consequently the connected miscellaneous petition is also closed.
