Writ Petition (Criminal) filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Commissioner of Police Tambaram City, the 1st respondent herein to directing the Assistant Commissioner, Selaiyur Range, Pallikkaranai District (Tambaram City Police) Chennai - 600 073, the 2nd respondent herein to register the case against the 5th to 8th respondents herein in accordance with law, on the basis of the petitioner's representation/complaint dated 22.12.2025, vide R.C.No. 3879/042116/COP-PG/TCP/2025 on the file of the 1st respondent herein. O R D E R
This writ petition (criminal) has been filed seeking to direct the 1st respondent to, in turn, direct the 2nd respondent to register a case against the 5th to 8th respondents, on the basis of the petitioner's representation/ complaint dated 22.12.2025.
2. Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of the respondents 1 to 4. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself. 2/5
3. Since no order adverse to the interests of the respondents 5 to 8 is passed, notice to the said respondents is dispensed with.
4. The learned Additional Public Prosecutor appearing for the respondents 1 to 4, submitted that the prayer sought by the petitioner in this petition is not maintainable, since no mandamus can be sought for registration of an FIR. However, he fairly submitted that the representation/ complaint dated 22.12.2025 made by the petitioner has already been forwarded to the 3rd respondent and now, enquiry is pending in C.P.No.155 of 2025. Hence, he submitted that appropriate action will be taken on the said complaint of the petitioner.
5. In view of the fair submission made by the learned Additional Public Prosecutor, this Court, without going into the merits of the case, directs the 3rd respondent to complete the enquiry pending in C.P.No.155 of 2025 and pass appropriate orders on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, after hearing the petitioner and the private respondents herein. 3/5
6. This writ petition (criminal) stands disposed of accordingly. No costs.
