ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.I, Tambaram, to number the petition filed by the __________Page 1 of 4

petitioner in Crl.M.P.Sr.No.6122 of 2025 for returning the original documents seized by the respondent Police in connection with Crime No.226 of 2021. 2.

The learned counsel for the petitioner submitted that the petitioner is the second accused in Crime No.226 of 2021 registered by the respondent Police for the offences under Sections 420, 467, 468 and 471 of IPC. During the course of investigation, the property documents belonging to the petitioner were seized and deposited before the Court. After completion of the investigation, the respondent Police referred the case as 'further action dropped'(FAD). Consequently, the petitioner had filed an application seeking return of the seized documents. However, the learned Magistrate returned the application without numbering it and did not pass any order for return of the documents. Aggrieved by the return of the application, the present petition has been filed. 3.

The learned counsel for the petitioner further submitted that six documents have been seized from the petitioner during the course of investigation and that the petitioner is entitled to return of the documents. He also submitted that although the petition was returned on 11.12.2025 and all objections were duly complied with, the learned Magistrate has still not numbered the petition.

The learned Government Advocate (Criminal Side) submitted that the documents were seized from the petitioner during the course of investigation and they were produced before the concerned Court in P.I.Nos.222 and 223 of 2021. He further submitted that the case has been referred as 'further action dropped'(FAD).

Taking into consideration the submissions made by the learned counsel on either side, there shall be a direction to the learned Judicial Magistrate No.I, Tambaram, to number the petition filed by the petitioner in Crl.M.P.Sr.No.6122 of 2025 and pass appropriate orders within a period of two weeks thereafter.

With the above direction, this Criminal Original Petition stands disposed of.
