ORDER

The present criminal original petition has been filed to register the complaint of the petitioner dated 14.3.2016.

2. It is the case of the petitioner that it is a Sevai Maiyam doing various social welfare activities. In Tiruvannamalai Town, number of shops are selling adulterated products more particularly in essential commodities like milk, water, etc. All the illegal and unauthorized sales are undertaken with the help of one Azhaguraja, the Authorized Officer. In the Food Safety Department, there are 19 officers are working in Tiruvannamalai under the said Azhaguraja. However, the said Azhguraja refused to permit them to take food samples. Further, he refused to give license under Food Safety Act to those persons who refused to give bribe to him. While so, the management of Hotel Ashoka applied for renewal of licence for which the said Azhaguraja demanded a sum of Rs.50,000/- as bribe.

Since the same was refused by the management, the said Azhguraja refused to grant license and the same was reported to the higher officials. In this regard, the petitioner lodged a complaint with the respondent to register a case based on the complaint given by the management of Hotel Ashok. But, till date, the respondent has not taken any action on the said complaint. Hence, the petition.

The second respondent has filed a counter affidavit, stating that the petitioner has sent four petitions containing allegations against the said Azhaguraja, Designated Officer, Food Safety and Drug Administration Department, Tiruvannamalai and out of four petitions, three petitions were forwarded to the Director, Food Safety and Drug Administration Department, Anna Salai, Chennai-2 as per the instructions issued in Para 10(3) of the DVAC Manual for necessary action and after receiving report, necessary action would be taken.

4. In view of the said statement made in the counter affidavit, I am of the opinion, there is no need for this Court to give any specific direction in this petition. Hence, recording the said statement made in the counter affidavit, the criminal original petition is closed.
