When the matter was taken up for hearing today, there was no representation on behalf of the appellant.

2. A perusal of the records shows that the 6th respondent died in the year 2011 and though M.P. No.1 of 2011 was filed to implead the legal heirs of the deceased 6th respondent, no notice was served on the proposed respondent as well as to the other respondents. In such circumstances, the present appeal is dismissed for non prosecution. No costs.
