This civil miscellaneous petition has been filed to condone the delay of 31 days in filing the above writ appeal.

2. Heard Mr.E.Veda Bagath Singh, learned Special Government Pleader for the petitioner State.

3. Mr.R.Sampath Kumar takes notice for the first respondent and he vehemently opposed to condone the delay. Mr.I.Abrar Md.Abdullah takes notice for the 2nd respondent and he has no serious objection in allowing the petition.

4. If plausible reasons are stated in the affidavit filed in support of the petition to condone the delay, that too for a very minimal delay of 31 days, normally the Court would not reject such plea. Here in the present case, it is only a short delay of 31 days, for which reasons have been stated. Even administrative delay would be causing delay in filing the appeal. Therefore, accepting the reasons stated, the delay is condoned and the petition is ordered.

5. Registry is directed to number the appeal and place the same for admission, if the papers are otherwise in order.
