The Official Liquidator v.

Comp.A.No.129 of 2017 in C.P.No.244 of 2015 T.S.SIVAGNANAM,J This is an application filed by the learned Official Liquidator seeking to take his report on record; to permit him to pay the security expenses every month from the common pool fund account and allow to recoup the same from the realization of assets of the company in liquidation; and for costs.

2. Heard the learned Official Liquidator.

3. M/s.Censtar Packaging Industries India Private Limited was ordered to be wound up on 04.1.2016 and the Official Liquidator attached to this Court was appointed as the Provisional Liquidator to take charge of the assets of the company in liquidation. Pursuant to the orders of this Court, the learned Official Liquidator issued notices to the Ex-Directors, the secured creditors and the petitioning creditor on 25.2.2016 so as to be present at the registered office on 01.3.2016 either in person or through authorized representative to hand over all the assets and effects of the company in liquidation.

The learned Official Liquidator also deputed his officials to the registered office of the company in liquidation to take possession of the assets and they also took possession of the factory premises at No.59, SIPCOT Industrial Estate, Gummidipoondi and reported that neither the ExDirectors nor the secured creditors were present till the completion of work. The learned Official Liquidator also engaged the services of M/s.Universal Security Services to safe guard the factory premises with effect from 01.3.2016 and deployed a few security guards.

Further, vide order dated 06.9.2016 in Comp.A.No.678 of 2016, this Court permitted the learned Official Liquidator to pay from the common pool fund account a sum of Rs.2,99,285/- to the said security agency for the services rendered between March and July 2016. Further, the said sum of Rs.2,99,285/- was paid on 26.10.2016. The said security has now submitted bills for the period between August and December 2016. Therefore, the learned Official Liquidator has filed this application.

6. Considering the report of the learned Official Liquidator, this application is ordered as prayed for.
