C.M.P.No.754 of 2011 in S.A.No.386 of 2004 P.DHANABAL, J.

This petition has been filed to implead the legal heirs of the respondent as respondents 2 to 4 in the second appeal.

2. The learned counsel for the other side has no objection to allow this petition.

3.Considering the reasons stated by the petitioner that due to the death of the sole respondent, the proposed parties who are the legal heirs of the sole respondent are to be impleaded, this Court is of the view that impleading is to be ordered as they are proper and necessary parties in the second appeal.

Accordingly, this petition is allowed.
