Today the matter is taken up for hearing under the caption 'For Being Mentioned' at the instance of learned counsel for the petitioner.
2. Learned counsel for the petitioners submitted that this Court by order dated 08.12.2025, has disposed of the W.P.No.2369 of 2025 with a direction, directing the Subordinate Court, Dharapuram to number the suit filed by the petitioners for rectification of the mistakes and decide the same on merits. He further submitted that due to inadvertance, in paragraph 3 of the order, the name of the Court has been wrongly typed as 'Subordinate Court, Dharapuram, instead of 'District Munsif Court, Dharapuram'. Stating so, he prayed for issuing suitable directions.
3. In view of the submission made by the learned counsel for the petitioners, in the order passed by this court on 08.12.2025, in paragraph 3, wherever the terms 'Subordinate Court, Dharapuram' occurs, the same shall be substituted as 'District Munsif Court, Dharapuram'.
4. In other aspects, the earlier order shall stand unaltered.

The petitioner seeks a direction to the respondents to list the Lok Adalat Case No.322 of 2021 connected to the suit in O.S.No.95 of 2020 on the file of the Subordinate Court, Dharapuram, Tiruppur District, on the file of the 2nd respondent for hearing the parties and to issue the correct copy of the compromise decree.
2.It is the case of the petitioners that, before the Lok Adalat, in Lok Adalat Case No.322 of 2021, the petitioners had mutually entered into a settlement in O.S.No.95 of 2020 by filing a compromise memo and based on the compromise, a Lok Adalat Award was passed on 11.12.2021 and finally, decree in the suit was also passed in terms of the compromise. The grievance of the petitioner is that, while recording the compromise in Lok Adalat, the Survey Numbers, boundaries and Village have been wrongly mentioned. According to the petitioners, this mistake had crept in the Award, as some of the survey numbers and their extent in the suit schedule properties have been misstated in the plaint itself. When the petitioners filed a declaration suit for rectification of the said mistake, the suit was
returned as not maintainable on 30.11.2022. Hence, the petitioners have approached this Court by way of a writ petition to rectify the mistake. 3.A reading of the affidavit indicates that, even in the plaint, the said mistake had crept in. Now, after the Lok Adalat Award came to be passed based on the compromise, now the petitioners want to correct the same by way of this writ petition. At the outset, this Court is of the view that this writ petition cannot be maintained. If at all there are some differences in the Lok Adalat Award and if any amendment is required, it has to be done only as per the procedure contemplated under the Civil Procedure Code. Now, the petitioners also submit that they have filed a suit before the Subordinate Court, Dharapuram, for rectification of the mistakes. The parties to the suit are certainly entitled to seek rectification. In such view of the matter, let the Subordinate Court, Dharapuram, number the suit and decide the same on its own merits and pass appropriate orders.
4.With the above direction, this writ petition is disposed of. No costs. 08.12.2025 mkn
