ORDER

The petitioners / accused in a private complaint lodged by the respondent under Section 138 of the Negotiable Instruments Act, was convicted by the Trial Court in STC.No.2286 of 2023 by order dated 15.10.2025. Aggrieved by the order dated 15.10.2025, the petitioners preferred an appeal before the learned XIX Additional City Civil Court, Chennai, in Crl.A.No.1328 of 2025 and filed suspension of sentence petition in Crl.M.P.No.1 of 2025. The learned XIX Additional Judge, City Civil Court, Chennai, by order dated 04.11.2025 granted suspension of sentence and had directed the petitioners to deposit 20% of the compensation amount before the Trial Court.

2.Aggrieved against the said order dated 04.11.2025, the petitioners approached this Court by filing Crl.O.P.No.33317 of 2025. This Court by order dated 05.12.2025, directed the petitioners to deposit 10% of the compensation amount within a period of two weeks from 05.12.2025. The petitioners had made arrangements and taken demand draft for a sum of Rs.4,80,000/-, favouring The Chief Metropolitan Magistrate, Egmore, Chennai - 600 008. Thereafter, the same was not received for the reason that this Court by order dated 05.12.2025 in Crl.O.P.No.33317 of 2025, has directed the petitioner to deposit 10% of the compensation amount before the Trial Court. 2 / 4

3.The Trial Court which has passed order in STC.No.2286 of 2023 is XXVII Metropolitan Magistrate Court, Saidapet, Chennai - 600 015. Hence, the petitioner is directed to take the demand draft for a sum of Rs.4,80,000/- in favour of the XXVII Metropolitan Magistrate Court, Saidapet, Chennai - 600 015, and to deposit the amount before the Trail Court within a period of two (2) weeks from the date of uploading this order. It is made clear that no further extension of time will be granted.

4.With the above directions, this Criminal Miscellaneous Petition is ordered. No costs.
