The above application is filed for condoning the day of 25 days in filing the petition to set aside the dismissal order dated 20.01.2020 in Appeal A.S.No.755 of 2005.

2. The 3rd appellant who has sworn to the affidavit has given the sufficient reasons as to why the parties were unable to get in touch and to give instructions to their counsel to proceed with the first appeal. Considering the above, this application is allowed and the delay is condoned.

3. The Registry is directed to number the restoration application in Appeal A.S.No.755 of 2005 and list the matter on 06.10.2021.
