This Miscellaneous Petition is filed to condone the delay of 70 days in filing the appeal.

2. This Court ordered notice on 22.01.2002. Almost eighteen years lapsed, till today, the petitioner has not served notice to the respondent as per the order of this Court. Thus, an inference is to be drawn that the petitioner is not interested in pursuing the litigation. Therefore, this Court is not inclined to consider the petition.

3. Accordingly, the miscellaneous petition stands dismissed and C.M.A.SR.No.74746 of 2001 is rejected at the SR Stage itself. No costs.
