Prayer: The Second Appeal is filed under Section 100 of CPC, against the judgment and decree of the learned Subordinate Judge, Tindivanam made in A.S.No.28 of 1990 dated 26.11.1997, confirming the judgment and decree of the learned Principal District Munsif, Tindivanam made in I.A.No.636 of 1982 in O.S.No.1221 of 1973 dated 28.04.1989.

JUDGMENT

A memo had been filed by the learned counsel for the appellants, which is as follows:- "It is respectfully submitted that I am the counsel appearing for the appellants in S.A.No.1205 of 1998. When I tried to contact the parties in order to know the position, they informed me that they are not interested in pursuing the matter as they compromised themselves in respect of the subject matter of the second appeal. When we insisted for the letter, they have not turned up."

2. In view of the same, the Second Appeal is dismissed for non prosecution. No costs. The memo for withdrawal dated 19.12.2018, shall form part of the order.
