Petition under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 04.01.2016 within a stipulated period and consequently direct the respondents to issue the tsunami house allotment giving first preference to the petitioner before issuing house allotment to ten thousand flood victims.

The petitioner and her family are victims of tsunami. According to the petitioner, pursuant to the orders passed by this Court in W.P. No. 9192/2013 dated 09.04.2013, the name of her son, when he was alive, was placed in Tamil Nadu Slum https://hcservices.ecourts.gov.in/hcservices/
Clearance Board tsunami list at No.133. Subsequently, her son died on 15.10.2013 and thereafter, the tsunami house allotment proceedings were stopped on the ground that the petitioner's son was no more. Though the petitioner gave a representation to the 3rd respondent Board seeking transfer of the house in her name as a legal heir, no orders were forthcoming. Again, the petitioner made a representation to the respondents on 04.01.2016 seeking allotment of house. Since the said representation has not been disposed of, the petitioner has come forward with the present writ petition.

Considering the above, the 3rd respondent is directed to consider the representation of the petitioner dated 04.01.2016 and pass appropriate orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
