C.M.P.Nos.968 & 969 of 2013 in S.A.Nos.1005 & 1006 of 2004 C.V.KARTHIKEYAN, J.

The 7th respondent in S.A.No.1005 of 2004, who was also the 13th respondent in S.A.No.1006 of 2004, Sankaranarayanan had unfortunately died pending the Second Appeals. Both the Civil Miscellaneous Petitions have been filed by the appellants seeking to bring on record his legal representatives as respondents 8, 9, 10 and 11 in S.A.No.1005 of 2004 and as respondents 14, 15, 16 and 17 in S.A.No.1006 of 2004. 2.In the affidavit filed in support of the said applications, the aforesaid Sankaranarayanan had unfortunately died on 29.10.2010 leaving behind the respondents who are proposed to be impleaded as his legal representatives.

3.These applications appear to have filed in view of the fact that notice had been directed and Mr.Thirugnanam learned counsel entered 2/2 https://www.mhc.tn.gov.in/judis

C.V.KARTHIKEYAN.,J smv appearance on behalf of the proposed respondents. Since, the Second Appeal had been admitted, the burden is cast on the Court to hear the Appeal on merits. Hence, both the Civil Miscellaneous Petitions are allowed.
