Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, direct the 2nd respondent to consider the Sub Division Patta Transfer vide Can No.13302115035179 and application No. 2021/0105/02/268929 dated 19/07/2021 and further direct the 2nd respondent to inspect, measure and issue sub-Division patta in favour of the writ petitioner.

O R D E R

The present writ petition has been filed to direct 2nd respondent to consider the Sub Division Patta Transfer vide Can No.13302115035179 and application No. 2021/0105/02/268929 dated 19/07/2021 and further direct the 2nd respondent to inspect, measure and issue sub-Division patta in favour of the writ petitioner.

2.The case of the petitioner is that the petitioner had purchased the property from Mr.Gopinathan through his power agent Mrs.Gomathy on 30.03.1994 bearing Document Nos. 1034 of

1994 registered at S.R.O. Madras South. However, the petitioner is the legal owner of the property but, the patta stands in the name of previous owner. The petitioner submits that the survey numbers 29 and 30 subdivided as 29/2 and 20/1A1A. Further, the petitioner submitted all the relevant documents to the second respondent to issue sub division patta in his name. But, the second respondent did not consider my representation. Therefore, the petitioner has filed the present writ petition before this Court seeking the above said prayer.

3. The leanred counsel for the petitioner submitted that this Court may issue a direction to the second respondent to consider the petitioner's representation dated 19.07.2021 within the stipulated time as fixed by this Court.

4. The learned Government Advocate submitted that the representation of the petitioner will be considered and appropriate orders will be passed within the time stipulated by this Court.

5. Considering the facts and circumstances of the case and the limited request sought for by the petitioner, this court directs the respondents to consider the representation of the petitioner dated 19.07.2021 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the aforesaid directions, this Writ Petition stands disposed of. No costs.
