The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 7(5) & 20(2) of Cigarette and other Tobacco Products Act, 2003 r/w Section 123 of BNS, 2023 in Crime No.02 of 2026, registered on the file of the respondent, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in possession of 55 kgs of Tobacco products. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the investigation in this case is still pending. He further submitted that apart from this case, the petitioner is having one previous case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner and the fact that the investigation is pending and if the anticipatory bail is granted, it would hamper investigation, hence this Court is not inclined to grant bail to the petitioner.
