(Order of the court was made by R.Mahadevan, J.) This petition has been filed by the petitioner / A2 seeking to modify the condition imposed in paragraph No.4(i) of the order dated 30.11.2022 passed in Crl.M.P.No.17341 of 2022 in Crl.Appeal No.158 of 2021, wherein, this court, while granting suspension of sentence, has directed the petitioner to execute a bond for a sum of Rs.25,000/-, with two sureties, of whom, one should be a blood relative, each for like sum to the satisfaction the Principal District and Sessions Judge, Tiruvarur.

2. The learned counsel for the petitioner would submit that the father of the petitioner passed away and his mother is also bedridden due to chronic tuberculosis ailment; that, the brother of the petitioner is the first accused in S.C.No.104 of 2017 and is still serving the sentence inside the jail since 15.03.2021; and that, his sister/A6 was a life convict and was released on bail. Hence, the petitioner is unable to furnish a blood relative as surety. Therefore, the learned counsel prayed to modify the condition by furnishing a close relative i.e., the petitioner's father's brother's wife / Thaiyalai Vadivelu as surety, instead of blood relative.

3. The learned Additional Public Prosecutor has no serious objection for ordering this petition.

4. Considering the reasons stated in the affidavit filed in support of this petition and also taking note of the no objection expressed on the side of the respondent/Police, we are inclined to modify the condition imposed in paragraph No.4(i) of order dated 30.11.2022 in Crl.M.P.No.17341 of 2022 in Crl.Appeal No.158 of 2021 and is accordingly, modified as follows: "4.1. Ranjith Kannan, the petitioner / A2 shall execute a bond for a sum of Rs.25,000/- with two sureties, of whom, one should be a close relative / the petitioner's father's brother's wife, each for a like sum to the satisfaction of the Principal District and Sessions Judge, Tiruvarur.

Except the above, there is no modification in respect of other aspects.

5. Accordingly, this petition is ordered.
