J U D G M E N T
Learned Counsel appearing for the appellant stated that the suit has been filed by the respondent-G.Nagarajan via permanent injunction, restraining the Bank from taking any action on his community certificate produced by him at the time of the appointment and not to terminate his service and the https://hcservices.ecourts.gov.in/hcservices/
declaration, as sought for in this suit has been granted by the Trial Court and an appeal confirmed. Hence, the Central Bank of India has preferred this appeal.
2. Learned Counsel appearing for the Bank submitted that pending disposal of the above second appeal, the contesting respondent viz., the plaintiff was permitted to retire from service and all the terminal benefits has also been settled and the matter has become infructuous.
3. Taking note of the subsequent development, as submitted by the learned counsel appearing for the appellant-Bank, I am of the view that with the above instructions there is no need to go into the issue and accordingly, this appeal has been dismissed as infructuous. No costs. Consequently, the connected civil miscellaneous petition is closed.
