Prayer: Criminal Original Petition has been filed under Section 482 Cr.P.C to direct the 2nd respondent police to give adequate police protection to the petitioner for fencing the barbed wire around four corners of the petitioner land in Old S.F.No.44/1B, New S.F.No.44/1B5 Total extents 460 Sq.ft out of 0.04 Cents situated at No.15, Muttukadu Village, Tiruporur Taluk, Kanchipuram District now Chengalpattu District. ORDER

This criminal original petition has been filed to give adequate police protection to the petitioner for fencing the barbed wire around four corners of the petitioner land in Old S.F.No.44/1B, New S.F.No.44/1B5 Total extents 460 Sq.ft out of 0.04 Cents situated at No.15, Muttukadu Village, Tiruporur Taluk, Kanchipuram District now Chengalpattu District.

2. The petitioner owns a small property in Muttukadu Village and obtained patta No.1392. The petitioner along with the property documents and other documents applied for planning permission with the Muttukkadu Panchayat. The said officer of the Panchayat, on verification of the petitioner's allotment of land, Thasildar report and resolution passed by the Panchayat, granted planning and building permission to the petitioner. The petitioner in Na.Ka.No.10/2021/Uu.Say dated 06.07.2021, obtained a planning permission in put up a construction and when she wanted to earmark her property by putting fence the same was objected by the respondents viz., 3 to 5, which is illegal. The respondent police is not taking any action on the complaint of the petitioner, which has emboldened respondents 3 to 5 to further resist and not permit the petitioner to put up a construction.

3.The learned Government Advocate (Crl.side) submits that the second respondent police, so far not received any complaint from the petitioner. If the petitioner appears before the second respondent police along with the copy of the complaint and necessary document, on verification of the same, the respondent police shall provide police protection. 4.The learned counsel for the petitioner submits that the petitioner is ready and willing to appear before the respondent police on any given date.

5.In view of the same, the petitioner is directed to appear before the respondent police on 24.01.2022 along with copy of the complaint and thereafter, the respondent police is directed to enquire and proceed the matter in accordance with law. 6.With the above direction, this Criminal Original Petition is disposed of.
