This Criminal Original Petition has been filed to direct the respondent to register the complaint given by the petitioner dated 02.02.2016 (C.S.R.No.115/2015) and to take action in accordance with law.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. The learned Additional Public Prosecutor submitted that based on the complaint lodged by the petitioner, the https://hcservices.ecourts.gov.in/hcservices/
petition enquiry is pending in CSR.No.115 of 2016 before the second respondent.
4. Recording the submission of the learned Additional Public Prosecutor, the second respondent police is directed to conduct enquiry expeditiously and the petitioner is directed to co-operate with the enquiry. During the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.
5. With the above direction, this Criminal Original Petition is closed.
