O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982, and 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.291 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The allegation against this petitioner is that, the petitioner who is ranked as A1 in this case joined hands with the other accused and involved in storing the rice meant for Public Distribution System to the quantity of 1600 kgs and when the officials have visited the place, the accused ran away from there and hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and there is no material to prove the accusation; the petitioner has no previous case and is ready to co-operate with the investigation and also ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner along with the co-accused illegally stored 1600 kgs of rice meant for Public Distribution System, that the investigation of this case is pending. A1 has been arrested and he has also categorically revealed the name of the other accused and how the rice were collected and the petitioner is concerned he 2/4

is the main accused in this case.

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, nature and quantity of material involved in this case and the fact that the petitioner is the main accused and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner since if bail is granted he will indulge in similar kind of offences.
