ORDER

A memo dated 21.01.2019 had been filed by the learned counsel for the appellants. The memo reads as follows:- "It is respectfully submitted that the letter of intimation sent to the 1st appellant by RPAD was received by him. In spite of it he has not contacted. Hence in the absence of any information whether anything survives, the counsel for the appellants in the above Second Appeal is reporting no instruction".

2. A perusal of the records shows that the appellants were defendants 4&5 in the suit. Since the appeal is of the year 1998, in view of the above said memo, this appeal is dismissed for non-prosecution. No costs. The memo shall form part of the record.
