J U D G M E N T

[Judgment of the Court was delivered by K.K. SASIDHARAN,J.] The appellant was transferred from Avadi to Gujarat. The writ petition filed by the appellant challenging the order of transfer was dismissed by the learned single Judge. The order is under challenge at the instance of the unsuccessful writ petitioner.

2. This matter was argued at length on 12 June 2018. When a question was posed to the learned counsel for the appellant as to whether the appellant is prepared to join at the transferred place in case reasonable time is given, the learned counsel took time to take instructions. Accordingly, the appeal was adjourned to be posted today.

3. When the intra court appeal is taken up for hearing today, the learned counsel for the appellant produced an undertaking affidavit dated 18 June 2018 sworn to by the appellant. According to the appellant, she would join at the transferred place positively on 1 October 2018. The affidavit dated 18 June 2018 is taken on record.

4. The appellant is permitted to continue her service at Avadi till 30 September 2018 on condition that she should join at the transferred place by 1 October 2018.

5. The intra court appeal is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
