CRIME NO.998 OF 2021 For Petitioner : M/S. P.CHANDRASEKAR Advocate For Respondent : MR.A.GOKULAKRISHNAN, Additional public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent Police for the alleged offences under Sections 406 and 420 of IPC, in Crime No.998 of 2021 on the file of the respondent/Police, seeks anticipatory bail.
2.It is the case of the prosecution that there are totally four accused involved in this case and the petitioner is A3. The case of the prosecution is that the petitioner and other accused persons, had looted several Crores of Rupees (more than Rs.100/- Crores) from the general public, including the de-facto complainant for exorbitant interest and personal gains, and thereafter, they had cheated the defacto complainant and other victims. However, they neither paid interest nor re-paid the amount to the de-facto complainant and other victims. Hence, the complaint was registered against the petitioner and other accused persons.
3.The learned counsel for the petitioner submitted that the other accused persons who are the main key accused, have committed the said offences as alleged by the prosecution. He futher submitted that the petitioner had not involved in this case and he is an innocent person and had not committed any offences as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that there are totally four accused in this case and the petitioner is arrayed as A3. The petitioner and other accused persons had lured several Crores of Ruppees (more than Rs.100/- Crores) from the general public for exorbitant interest and thereafter, they had cheated them including the de-facto complainant. Hence, he vehmently opposed for grant of anticipatory bail to the petitioner.
5. From the above submissions, it is seen that the petitioner and other accused persons are the master brain behind the entire Crime. It is also seen from the documents, that the petitioner and other accused persons had deceived several Crores of Rupees from the general public for exorbitant interest and thereafter, they had cheated the victims. The petitioner herein has committed very serious offence. 6.Taking into consideration the nature of the offences committed by the petitioner and also the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
