The Civil Miscellaneous Appeal in M.C.O.P.No.1403 of 2003 pending on the file of High Court, Madras has been referred to Lok Adalat for conciliation today.
2. On perusal of the record, as early as on 20.10.2014, a memo has been filed by the appellant /Insurance Company that the appeal may be dismissed as withdrawn since the claimant himself /1st respondent herein has issued letter dated 26.09.2008 https://hcservices.ecourts.gov.in/hcservices/
agreeing to withdraw the MCOP itself and not prosecute the claim against the Insurance Company/appellant herein.
3. In view of the memo filed by the appellant/Insurance Company, the appeal stands dismissed as withdrawn. The memo along with letter issued by the claimant has been enclosed along with award.
4. The Judgment and Decree of the Tribunal will remain undisturbed in view of the appeal has been dismissed as withdrawn. The same is hereby recorded and the appeal is dismissed and the Tribunal award is confirmed. The full Court fee shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu CourtFees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
