IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Criminal Jurisdiction ) Monday, the Second day of July Two Thousand Eighteen PRESENT The Hon`ble Mr Justice P. N. PRAKASH CRIMINAL ORIGINAL PETITION No.5060 of 2018 ARUMUGAM [ PETITIONER / ACCUSED ] Vs THE STATE REP BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, UDUMALPET POLICE STATION, UDUMALPET, TIRUPPUR DISTRICT CR.NO.375 OF 2017.

For Petitioner : M/S.N.PONRAJ Advocate For Respondent : M/S.KRITIKA KAMAL.P, GOVERNMENT ADVOCATE [CRL.SIDE] PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Sections 174 of Cr.P.C., @ 306 of IPC in Crime No.375 of 2017 on the file of the respondent police, seeks anticipatory bail.

2. This is the second anticipatory bail petition. The first anticipatory bail petition filed by the petitioner has been dismissed by this Court on 22.08.2017 in Crl.OP.No.16380 of 2017, by a detailed order.

3. In fact, this Court in the same order, has granted anticipatory bail to Thangavelu (A1) and Sekar (A3), as this Court found that they were only the witnesses to the agreement that was entered into between the petitioner and the deceased Saravana Kumar. Except the fact that the petitioner has not been arrested by the police so far, there is no other change in the situation for granting anticipatory bail.

4. Mr.N.Ponraj, learned counsel for the petitioner submitted that the investigation is almost completed.

5. However, the learned Government Advocate (Crl. Side) submitted that the post-mortem report is ready and the final report has not been filed.

6. Be that as it may, this Court does not find any change in the situation for granting the relief of anticipatory bail to the petitioner. Hence, this petition is dismissed, as being devoid of merits.

-sd/- 02/07/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
