Writ Petition is file under Article 226 of the Constitution of India seeking to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the 2nd respondent in his proceedings Na.Ka.No.5095 /A4/07 dt 11.4.2008 and quash the same and direct the respondents to approve the appointment of the petitioner as Office Assistant from the date of appointment and confer all the consequential benefits. J U D G M E N T

(Judgment of the Court was delivered by K.K.SASIDHARAN, J.,) The order, directing the appellants to regularise the appointment of the 1st respondent as Office Assistant is under challenge, at the instance of the State.

2. When the intra court appeal is taken up for hearing, the learned Special Government Pleader, on instruction, submitted that the Education Department has already approved the appointment of the 1st respondent and as such, nothing survives for adjudication. The said factual position is confirmed by the learned counsel for the respondents also.

3. The intra court appeal is dismissed as infructuous, taking into account the subsequent events as noted above. No costs. Consequently, connected miscellaneous petition is closed.
