Respondents Prayer : Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to consider the petitioner's representation dated 29.12.2020 with regard to the encroachments made in a pond bearing Survey No.238/32 situated in Melathangal Village, Tiruvannamalai District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This writ petition has been filed to seek a direction on the respondents to consider the representation made by the petitioner against the encroachments made in a pond bearing Survey No.238/32 situated in Melathangal Village, Tiruvannamalai District.

2. When the writ petition was taken up on 4.4.2022, learned Government Pleader appearing for the respondents disputed the existence of a pond in Survey No.238/32 and accordingly, he was directed to find out the survey number of the pond and if any encroachment made therein, the same was directed to be removed within two weeks and a status report to that effect be submitted.

3. Today, when the writ petition is taken up for hearing, learned Additional Advocate General submitted that action as per the law has already been initiated to remove the encroachment.

4. The aforesaid statement of learned Additional Advocate General has not been opposed by learned counsel for the petitioner.

5. In view of the above, now nothing survives for consideration in this writ petition, as pursuant to the representation made by the petitioner and as per the earlier direction of this Court, action has already been initiated by the respondents to remove the encroachment.

6. The writ petition is disposed of with a direction to the respondents to conclude the action as per law within a reasonable period of time. No costs.
