Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to ralax the condition imposed in Crl. A. No. 324 of 2017 order dated 17.07.2017 on the file of the file of this Honble Court.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.THENRAJAN, Advocate for the petitioner and of PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Heard both sides.
2. This Court granted bail to the petitioner in Crl.A.No.324 of 2017 dated 17.07.2017 for the offences under Sections 294(b), 323, 324, 341, 354, 506(ii) and 376 r/w 511 IPC and Section 3(1)(w)(i), 3(2)(V), 3(2)(Va) of the SC/ST (POA) Act, subject to the condition that he should stay at Madurai and report before the Inspector of Police, Thallakulam Police Station, Madurai, daily at 10.30 a.m. until further orders. The present petition has been filed to relax the said condition.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an engineering graduate and he is unable to find any job at Madurai and he is suffering for his survival and that, he pleaded for relaxation of the said condition.
4. The learned Government Advocate [Criminal Side] appearing for the respondent would submit that tension still prevailing in the locality, however, he has no objection to modify the condition suitably.
5. Having regard to the submissions of the learned counsel for the petitioner and the learned Government Advocate [Criminal Side] and taking into account the difficulty expressed by the petitioner, I am inclined to modify the condition. Accordingly, the condition imposed by this Court in Crl.A.No.324 of 2017 dated 17.07.2017 is modified to the effect that the petitioner shall stay at Chennai and report before the Inspector of Police, B-1 North Beach Police Station, Chennai, daily at 9.00 a.m. until further orders. The other conditions shall remain unaltered.
6. This Criminal Miscellaneous Petition is ordered accordingly.
