PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to transfer the investigation in Crime No.3244 of 2015 on the file of the 1st respondent police to the 2nd respondent ivz., Inspector of Police, CBCID, Chennai for proper investigation.

ORDER

This petition has been filed seeking for transfer of investigation.

2. The petitioner is working with the Transport Corporation, Chennai. On 13.08.2015, he had left certain golden jewelery which is claimed to be weighing 14 sovereigns, in the dress changing room and the same was stolen. A police complaint was given to the 1st respondent police and a case was registered in Crime No.3244 of 2015.

3. The grievance of the petitioner is that that respondent police did not conduct the investigation properly. The petitioner had specifically named certain https://hcservices.ecourts.gov.in/hcservices/

persons against whom the petitioner had suspicion. However, these persons were never investigated by the 1st respondent. Therefore, the present petition has been filed seeking for transfer of investigation.

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing on behalf of the respondent.

Taking into consideration the facts and circumstances of the case, the investigation in Crime No.3244 of 2015 is transferred to the file of the Assistant Commissioner of Police, Triplicane and the 1st respondent shall hand over the entire case diary to the Assistant Commissioner of Police, Triplicane within a period of two weeks from the date of receipt of copy of this order. The Assistant Commissioner of Police, Triplicane shall take up the investigation immediately and shall proceed against the accused persons in accordance with law and shall complete the investigation as expeditiously as possible.

6. This Criminal Original Petition is disposed of with the above direction.
