ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 08.12.2021 for the offences under Sections 7, 20(1) of COTPA Act 2003, Sections 52, 59 of Food Safety and Standards act 2006 and under Sections 273, 328 of IPC in Crime No.872 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioners were illegally transported the 50 bags of contraband tobacco products. Hence, the complaint.

3.The learned counsel appearing for the petitioners submitted that the petitioner have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that they have been suffering incarceration for more than twenty days. Hence prays for grant of bail. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate (Crl.Side) submitted that the petitioners were found in illegal possession of contraband tobacco products and its worth about rupees five lakhs and he further submitted that investigation is not yet completed . Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that investigation is not yet completed, this court is not inclined to grant bail to the petitioners.
