ORDER

The petitioner asserts title over an extent of 1200 sq.ft. in the survey numbers mentioned in paragraph No.3 of the affidavit on the basis of Document No.2347/2005. In view of a rival claim relating thereto, the petitioner instituted O.S.No.18 of 2022 before the District Munsif, Rasipuram. The said suit is pending. Meanwhile, upon coming to know that the fourth respondent is endeavouring to alienate the relevant property, the petitioner has filed this writ petition.

2. Mr.Stalin Abhimanyu, learned Additional Government Pleader, accepts notice for respondents 1 and 2 and Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the third respondent.

From the affidavit of the petitioner, it is clear that the petitioner has filed a suit for declaration against the third and fourth respondents herein and that such suit is pending before the District Munsif, Rasipuram in O.S.No.18 of 2022. Therefore, if the petitioner apprehends that the property would be alienated at the instance of the private respondent, it is open to the petitioner to seek interim relief in the pending suit.

4. With the above observations, this writ petition is disposed of without any order as to costs. Consequently, connected miscellaneous petitions are closed.
