C.M.P.No.7982 of 2026 in C.M.A.SR.No.89177 of 2016 C.M.P.No.7982 of 2026 in C.M.A.SR.No.89177 of 2016 C.V.KARTHIKEYAN, J., AND K.RAJASEKAR.J., (Order of the Court was made by C.V.KARTHIKEYAN, J.,) This petition has been filed seeking to condone the delay of 2653 days in re-presenting the appeal in C.M.A.SR.No.89177 of 2016.

2. It is seen from the records that yet another appeal had been filed in C.M.A.No.2318 of 2019. In this appeal, the Registry had returned the papers stating that cause title requires amendments. It is seen from the affidavit that it had been consistently re-presented, but again it was returned and again represented. In the meanwhile, the counsel had also been changed. Therefore, the appellant cannot be faulted for the delay in re-presenting the appeal. An opportunity will have to be granted to the appellant to present her case in the Court and the same has to be examined on merits.

3. Taking all factors into consideration, the delay in re-presenting the appeal is condoned.
