Mr.P.Cheralaadhan, learned counsel for appellant in CMA. No.2115 of 2024 and first respondent in CMA. No.422 of 2025 and, Mr.J.Michael Visuvasam, learned counsel for the appellant in CMA. No.422 of 2025 and second respondent in CMA. No.2115 of 2024 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT Both the Insurance Company and the Claimant are on appeal. In CMA. No.422 of 2025, Insurance Company is the appellant and CMA. No.2115 of 2024, the Claimant is the appellant, challenging the award of the Tribunal for a sum of Rs.11,50,000/-, for the injuries suffered by the claimant, in M.C.O.P.No.517 of 2019.
2. In compliance of the conditional order, the Insurance Company has already deposited a sum of Rs.5,75,000/- with accrued interest. After negotiations, the parties have now amicably arrived at a settlement for a sum of Rs.5,75,000/- (Rupees Five Lakhs and Seventy Five Thousand only) with accrued interest. The second respondent has already deposited the award amount of Rs.5,75,000/- along with accrued interest into the
account of the Tribunal and the first respondent/claimant is permitted to withdraw the same by filing formal petition. Award is passed accordingly.
5. In view of the settlement arrived at in CMA. No.422 of 2025, the learned counsel for the appellant in CMA. No.2115 of 2024 seeks permission to withdraw the CMA. No.2115 of 2024. Accordingly, CMA. No.2115 of 2024 is dismissed as withdrawn.
6. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal in CMA.No.422 of 2025 is disposed of accordingly. Consequently, connected Miscellaneous Petition is closed.

This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
