J U D G M E N T
The judgment and decree passed in A.S.No.102 of 2000 dated 29.09.2000 in confirming the fair and decreetal order passed in E.A.No.12 of 2000 in E.P.No.166 of 1987 in O.S.No.804 of 1986, is under challenge in the present civil miscellaneous second appeal.
2. When the matter is taken up for hearing, the learned counsel appearing for the appellant made a submission that the issues between the parties has already been settled out of Court.
3. In view of such submission, no further adjudication needs to be entertained with reference to the grounds raised in the present civil miscellaneous second appeal.
