ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for alleged offences punishable under Section 303(2) of BNS, in Crime No.248 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that, the petitioner herein has stolen the bike of de facto complainant. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. It is also submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate appearing for the respondent police reiterated the prosecution case and submitted that the stolen property has been recovered. Further, she submitted that there are totally ten previous cases pending against the petitioner and that the investigation in this case is also pending. Hence, she vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the allegation, and the fact that though the

property has been recovered, the petitioner is having ten previous bad antecedents, if the anticipatory bail is granted to the petitioner, the petitioner would indulge in similar offence, and, hence this Court is not inclined to grant bail to the petitioner.
