ORDER

This writ petition has been filed to direct the third respondent to subdivide the property morefully described in the prayer to this writ petition and

to issue separate patta in the name of the petitioner for the subdivided property based on the petitioner's representation dated 07.01.2025 within a time frame to be fixed by this Court.

2. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents and would submit that the petitioner will have to submit an online application to the respondents to enable the respondents to consider the petitioner's application seeking for subdivision and for issuance of separate patta.

3. The learned counsel for the petitioner on instructions would submit that the petitioner is willing to submit a fresh online application. The said undertaking given by the petitioner is recorded.

4. No prejudice would be caused to the respondents if the petitioner is directed to submit a fresh online application to the respondents, seeking for subdivision of the property and for issuance of separate patta and a direction is issued to the third respondent (Tahsildar) to consider the said application within a time frame to be fixed by this Court.

5. This Court is not expressing any opinion on the merits of the petitioner's application.

6. For the foregoing reasons, this Court directs the petitioner to submit a fresh online application with the third respondent, seeking for subdivision of the property morefully described in the prayer to this writ petition and for issuance of separate patta in the name of the petitioner within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said application within the stipulated time, the third respondent shall pass final orders on merits and in accordance with law on the said application within a period of twelve weeks thereafter.

7. Accordingly, this writ petition is disposed of.
