ORDER

Heard Mr.R.Nalliyappan, learned counsel for the petitioner and Mr.V.Shanmuga Sundar, learned Special Government Pleader accepts notice for the respondent.

By consent of both the parties, this writ petition is taken up for final disposal at the time of admission itself. 3.This Writ Petition has been filed for a mandamus seeking for a direction to the respondent to consider the petitioner's application dated 16.09.2019 seeking for grant of pistol licence within a time frame to be fixed by this Court. 4.

It is the case of the petitioner that he is possessing DBBL Gun licence and in addition to that he had applied for pistol licence with the respondent on 16.09.2019. According to him, the Revenue Divisional Officer, Namakkal in his proceedings dated 07.11.2019 has called for a report from the Tahsildar, Rasipuram about criminal antecedents of the petitioner. It is also his case that the respondent had also sought for a report from the Superintendent of Police, Namakkal. It is his case https://hcservices.ecourts.gov.in/hcservices/

that the Superintendent of Police, Namakkal has also recommended the case of the petitioner. However, according to him, till date, his application for pistol licence has not been considered and no final order has been passed. In such circumstances, this Writ Petition has been filed for early disposal of his application dated 16.09.2019 seeking for issuance of pistol licence.

The relief sought for in this writ petition is an innocuous one. The petitioner has applied for pistol licence with the respondent on 16.09.2019. It is also his case that his case has been recommended by the Superintendent of Police, Namakkal. However, it is his case that despite the said recommendation, till date no final order has been passed in his application seeking for issuance of pistol licence. 6.

No prejudice will be caused to the respondent, if the application of the petitioner dated 16.09.2019 seeking for issuance of pistol licence is considered on merits and in accordance with law.

7.For the foregoing reasons, this Court directs the respondent to consider the application dated 16.09.2019 of the petitioner seeking for issuance of pistol licence in addition to the DBBL Gun licence and pass final orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

8.With the aforesaid direction, this writ petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
