Writ Petitions filed under Article 226 of the Constitution of India, to issue a Writ of mandamus directing the 1st respondent herein to dispose the Petitioners Application dated 12.07.2021 filed by the Petitioner before the 1st Respondent as expeditiously as possible.

O R D E R

Mr.TNC Kaushik, learned Additional Government Pleader accepts notice for R1 and R3 and has received instructions enabling a final disposal of the matter even at the stage of admission. In the light of the order proposed to be passed, no notice is thought necessary at this juncture to R2.

2. The petitioners seek a disposal of their representation dated 12.07.2021 filed before the District Collector, Thiruvannamalai. Briefly stated, the petitioners are the wife and minor children of one late D.Ramji, who passed away on account of explosion of the LPG gas cylinder at their residence at 3/38, Subramani Koil Street, Kosapalayam, Arani, Thiruvannamalai District on 29.10.2020.

3. The first petitioner is the widow of the victim and a consumer with R3 i.e. Arni Co-Op MKTG SOC Indane Gas Service. She seeks a compensation in regard to demise of her husband on account of the explosion of LPG gas cylinder from R2 i.e. the Indian Oil Corporation.

4. In view of the circumstances as narrated above and seeing as the representation has been filed as early as in the month of July, 2021, the mandamus as sought for is issued. Section 7 of the Public Liability Insurance Act, 1991 (Act) provides for disposal of an application for relief within a period of three months of the receipt of the application.

5. The Act requires personal hearing of the persons seeking compensation and hence R1 shall hear the petitioners or their authorized representatives, if the petitioner so prefers, and shall dispose application dated 12.07.2021 within a period of four weeks from today.
