This Appeal is filed under Section 96 of the Civil Procedure Code against the judgment and decree dated 07.03.2008 in O.S.No.24/2006 before the Additional District Court, Pondicherry at Karaikal.

The learned counsel for the appellant submitted that the matter has been settled between the parties and the appellant has paid a sum of Rs.93,783/- towards full and final settlement in respect of the appellant alone and she seeks permission of this Court to withdraw the appeal and he has also made an endorsement to that effect.
2. The learned counsel appearing for the first respondent also submitted that the respondent has received the cheque.
3. In view of the submission and endorsement made by the learned counsel for the appellant, this Appeal is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed. Registry is directed to refund the Court fee if it is legally permissible.
