This petition has been filed seeking to condone the delay of 50 days in filing the Civil Miscellaneous Appeal.

Learned counsel for the petitioner/appellant submitted that R4 was set ex parte by the Tribunal.

Mr.D.Lakshmipathi, learned counsel who takes notice on behalf of respondents 1 to 3, stated that he has no objection to this petition being allowed.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 50 days in filing the appeal is condoned.
