Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioners representation dated 26.12.2021 consequently cancel the power of attorney documents Nos.1046/2012, 1047/2012, 1048/2012 and 1275/2012 and mortgage deed document No.4685/2020 registered on the file of the 3rd respondent's office by the respondents 4 & 5.

ORDER

This writ petition has been filed for issuance of Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioners' representation dated 26.12.2021, consequently cancel the power of attorney documents Nos.1046/2012, 1047/2012 and 1275/2012 and mortgage deed document No.4685/2020 registered on the file of the 3rd respondent's office by the respondents 4 & 5.

2. Heard, Mr.S.N.Subramani, learned counsel appearing for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the respondents 1 to 3.

3. The petitioner lodged a complaint as against the execution of Power of Attorney and subsequent mortgage deed by the respondents 4 and 5 before the second respondent and it is pending.

4. Considering the above, the second respondent is directed to conduct enquiry after issuance of notice to the petitioner and the respondents 4 and 5, by giving them an opportunity of hearing and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
