ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 01.10.2021 for the offences under Section 12(1b), 12(1A)(a) of Passport Act 1967, read with section 420, 465, 468 and 471 of IPC, read with Section 14(a) of Foreigners (Amendment) Act 2004 and Sec.18, 39, 40 of Unlawful Activities (Prevention) Act, in Crime No.01 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that A1 with the help of the petitioner and other accused has willfully concealed her nationality by producing fake and fabricated Indian Identification documents. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated. He would further submit that the petitioner has been suffering incarceration from 1.10.2021. Hence, he would pray for grant of bail. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor would raise strong objection stating that A1 with the help of the petitioner and other accused has willfully concealed her nationality by producing fake and fabricated Indian Identification documents and he further submits that already this Court dismissed the petitioner's bail petition in Crl.O.P.No.23437 of 2021.

5. Considering the gravity of the offence committed by the petitioner and also considering that there is no change of circumstances observed, this Court is not inclined to grant bail to the petitioner.
