This matter was taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for the appellants.

2. The learned counsel for appellants would submit that this Court by an order dated 09.10.2023 partly allowed the above appeal. However, the learned counsel would submit that as there is some modification in para 14 of the said order, he prayed to modify the same. Accordingly, the matter is listed today.

3. Heard the contentions of learned counsel for petitioner and perused the order.

4. Considering his submissions, para 14 of the order shall be substituted as follows:

In Para 14 at Page 7 "In the result, the appeal is partly allowed and the judgment and decree of the learned III Addl. District and Sessions Judge, Salem in O.S.No.35 of 2010 dated 03.02.2015 is confirmed in 1/3

so far as it relates to the prayer for specific performance of the agreement. The defendants are directed to pay a sum of Rs.4,00,000/- to the plaintiffs as discussed above within a period of four weeks from the date of receipt of copy of this order, failing which the plaintiffs can directly execute the said order through court. No costs."

5. Registry is directed to incorporate above correction in the Order of this Court in A.S.No.532 of 2015 dated 09.10.2023 and issue fresh order copy to the appellants.
