O R D E R
The present petition has been filed seeking a direction to the respondents to dispose of the appeal dated 22.01.2021 filed by the petitioner within the time stipulated by this Court.
2. Mr. T. Chezhiyan, learned Additional Government Pleader takes notice for the respondents 1 & 2.
3. According to the petitioner, he had applied for patta before the 2nd respondent in respect of the lands to an extent of 3 ares (approximately 6 1⁄2 cents), belonging to the petitioner which were originally purchased from one Vembuli Padayachi. Pursuant to which, the 2nd respondent had issued patta for some survey numbers however, the patta was not issued for the lands in Survey No.61/3B4A for an extent of 3 ares. On verification of the revenue records, the petitioner came to know that the patta for subject lands has wrongly been transferred to A. Logadass and A.Rajamanikam and the subsequent purchasers namely S.Moganapriya and R.Sundararaj. Since, the 2nd respondent had Page No:2/6
transferred patta in favour of the aforementioned persons without going through revenue records, the petitioner had filed an Appeal before the 1st respondent by way of registered post with acknowledgment card to cancel the wrong entry made in Survey No.64/3B4A for an extent of 3 ares. Pursuant to which, the 1st respondent had issued notice dated 22.01.2021 to the 2nd respondent to enquire into the matter and to file a detailed report on the same. However, till date, the same has not been considered. Hence, the present petition has been filed seeking the aforesaid relief.
4. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court directs the 2nd respondent to dispose of the petitioner's appeal dated 22.01.2021 within the time stipulated by this Court.
5. On the above contentions, heard the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
6. In view of the limited relief sought for, this Court without going into Page No:3/6
the merits of the case, directs the 2nd respondent to consider the appeal dated 22.01.2021 filed by the petitioner and dispose of the same in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
7. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No Costs.
