J U D G M E N T

The learned counsel appearing on behalf of the appellant made a submission that the Trial Court passed a judgment and decree on 11.08.2008. In a declaratory suit, where the husband sought for a declaration to declare that the husband of the respondent is not her husband.

2. It is brought to the notice of this Court that the appellant Sri.V.Padmanaban died on 03.05.2009. In view of the fact that the appellant passed away, the cause aroused did not exists as of now for further adjudication. Thus, the First Appeal stands dismissed as abated. No costs.
